Верховный Суд Российской Федерации

Верховный Суд Российской Федерации занимает важное положение в системе судов, так как принимает основополагающие решения по многим вопросам.

Верховный Суд РФ является высшей и последней надзорной инстанцией в Российской Федерации. Он рассматривает дела в порядке судебного надзора по надзорным жалобам и представлениям на вступившие в законную силу приговоры, решения, постановления и определения всех судов РФ.

Верховный Суд РФ призван выполнять как минимум три основные общественно значимые функции, реализация которых определяет его роль и место в судебной системе и системе других государственных органов:

1) выполнение задач, которые возлагаются на него как на высший судебный орган по гражданским, уголовным, административным и иным делам, подсудным судам общей юрисдикции;

2) осуществление в предусмотренных федеральным законом процессуальных формах надзора за деятельностью всех нижестоящих судов;

3) разъяснение вопросов судебной практики и право законодательной инициативы.

Верховный Суд Российской Федерации действует в следующем составе:

1) Пленум Верховного Суда Российской Федерации;

2) Президиум Верховного Суда Российской Федерации;

3) Апелляционная коллегия Верховного Суда Российской Федерации - в качестве судебной коллегии Верховного Суда Российской Федерации;

4) Судебная коллегия по административным делам Верховного Суда Российской Федерации;

5) Судебная коллегия по гражданским делам Верховного Суда Российской Федерации;

6) Судебная коллегия по уголовным делам Верховного Суда Российской Федерации;

7) Судебная коллегия по экономическим спорам Верховного Суда Российской Федерации;

8) Судебная коллегия по делам военнослужащих Верховного Суда Российской Федерации;

9) Дисциплинарная коллегия Верховного Суда Российской Федерации - в качестве судебной коллегии Верховного Суда Российской Федерации.

Именно на основании деятельности данного высшего органа формируется единая система восприятия норм законодательства, и единая структура применения данных норм в практической деятельности судов. Исходя из этого, можно сказать, что по своим полномочиям, судебной и правовой деятельности Верховный суд РФ по праву является высшим звеном судов общей юрисдикции.

   The Supreme Court of the Russian Federation occupies an important position in the system of courts, as it makes fundamental decisions on many issues.

   The Supreme Court of the Russian Federation is the highest and last supervisory authority in the Russian Federation. He considers cases in the order of judicial supervision on supervisory complaints and submissions against sentences, decisions, resolutions and rulings of all courts of the Russian Federation that have entered into force.

   The Supreme Court of the Russian Federation is called upon to perform at least three main socially significant functions, the implementation of which determines its role and place in the judicial system and the system of other state bodies:
   

1) fulfillment of the tasks assigned to it as the highest judicial body in civil, criminal, administrative and other cases, within the jurisdiction of courts of general jurisdiction;

2) exercising, in the procedural forms provided for by federal law, supervision over the activities of all lower courts;

3) clarification of issues of judicial practice and the right of legislative initiative.

4. The Supreme Court of the Russian Federation operates in the following composition:

1) Plenum of the Supreme Court of the Russian Federation;

2) Presidium of the Supreme Court of the Russian Federation;

3) the Board of Appeal of the Supreme Court of the Russian Federation - as a judicial board of the Supreme Court of the Russian Federation;

4) Judicial Collegium for Administrative Cases of the Supreme Court of the Russian Federation;

5) Judicial Collegium for Civil Cases of the Supreme Court of the Russian Federation;

6) Judicial Collegium for Criminal Cases of the Supreme Court of the Russian Federation;

7) Judicial Collegium for Economic Disputes of the Supreme Court of the Russian Federation;

8) Judicial Collegium for Military Personnel of the Supreme Court of the Russian Federation;

9) The Disciplinary Collegium of the Supreme Court of the Russian Federation - as a Judicial Collegium of the Supreme Court of the Russian Federation.

It is on the basis of the activities of this supreme body that a unified system of perception of the norms of legislation is formed, and a unified structure for the application of these norms in the practical activities of the courts. Based on this, we can say that in terms of its powers, judicial and legal activities, the Supreme Court of the Russian Federation is rightfully the highest echelon of courts of general jurisdiction.
